2 · General terms of sale and hire

English translation for information. In the event of any discrepancy, the French version prevails.

2.1 Scope

These general terms govern the sale of books and scores and the sale and hire of orchestral material from the catalogue of XXI Music Publishing, including the Ravel Edition. They are concluded between XXI Music Publishing ASBL, Place Communale 13, Boîte 2, 1630 Linkebeek (Belgium), company and VAT number BE 0687.982.002 (“the seller”), and any natural or legal person (“the customer”).

A “consumer” is a customer who is a natural person acting for purposes outside their professional activity. A “professional” is any other customer: orchestra, institution, ensemble, bookseller, reseller…

Any order implies acceptance of these terms, in the version in force on the date of the order. Specific conditions agreed in writing, in particular in a quotation or hire contract, prevail over these terms.

2.2 Products

The website 21music-publishing.com presents the XXI Music Publishing catalogue; it is not an online shop. The products offered are:

  • books (in particular the bound volumes of the Ravel Edition) and scores (study scores, voice and piano, solo piano, chamber music…);
  • orchestral material (full score and parts), for sale or hire. Some material is available for hire only; the type of material is shown in the catalogue and the orchestral library.

Products are offered while stocks last.

Territorial restrictions. For copyright reasons, some editions may not be sold or hired in certain territories. At present, the revised edition of L’Enfant et les sortilèges is not available in France, Spain and Mexico, and Boléro remains protected in certain territories, including the United States. It is the customer’s responsibility to ensure that they may import and use the products ordered in their country.

2.3 Orders

Books and scores. Orders are placed by email to sales@21-music.be, stating first name, surname, email address, country and full postal address. The seller sends an acknowledgement stating the total amount, including shipping, and the payment details. The sale is concluded on receipt of payment, confirmed by email.

Orchestral material. Sale and hire are on quotation, to be requested from sales@21-music.be. The order is firm once the customer has accepted the quotation in writing.

The seller may refuse an order in the event of a previous payment dispute, or if delivery is impossible because of the territorial restrictions set out in article 2.2.

2.4 Prices and VAT

Prices are expressed in euros. They are shown excluding VAT, with the amount including VAT given for information.

Belgian VAT at 6% applies to customers who are natural persons and to legal persons without a valid intra-community VAT number.

Shipping costs are added to the price; the amount is stated in the acknowledgement or quotation. For countries outside the European Union, any customs duties and import taxes are borne by the customer.

The price invoiced is the one in force on the day of the order.

2.5 Payment

Payment is made by bank transfer or PayPal, using the details provided by the seller. Books and scores are shipped after receipt of payment.

Invoices addressed to professional customers (orchestras, institutions, resellers…) are payable within 30 days of issue, unless another term is stated on the invoice or quotation.

Professional customers: any invoice unpaid on the due date automatically and without formal notice bears late-payment interest at the rate set by the Belgian law of 2 August 2002 on combating late payment in commercial transactions, plus a fixed indemnity of 15% of the amount due, with a minimum of €50. Invoices are deemed accepted unless disputed in writing within eight days of receipt.

Consumer customers: in the event of late payment, the statutory provisions applicable to consumers apply, including a prior free reminder.

2.6 Delivery

Shipments are made by carrier (UPS, DHL…), to a pick-up point or to the customer’s address. Delivery times are indicative; unless otherwise agreed, delivery takes place no later than 30 days after the sale is concluded.

For consumer customers, the risk of loss or damage passes on receipt of the goods. For professional customers, goods travel at the customer’s risk from the moment they are handed to the carrier.

2.7 Hire of orchestral material

Hire covers complete sets (full score and parts). The hire period, the concerts or performances covered and the price are set out in the quotation or hire contract.

Hired material remains the property of the seller. It must be returned complete and in good condition by the agreed date. Markings are permitted in pencil only. Any reproduction of the material, in whole or in part, is prohibited.

Missing or damaged parts, as well as any late return, may be invoiced in accordance with the hire contract.

Declarations and fees relating to the public performance, recording or broadcasting of the works are the responsibility of the organiser, with the relevant collecting societies.

2.8 Retention of title

Goods sold remain the property of the seller until the price has been paid in full.

2.9 Right of withdrawal

Consumer customers have 14 days from receipt of the product to withdraw, without giving reasons or paying any penalty.

They notify their decision by an unambiguous statement, by email to sales@21-music.be (subject: “Withdrawal” followed by the order number) or by post to XXI Music Publishing ASBL, Place Communale 13, Boîte 2, 1630 Linkebeek (Belgium). They then return the product, complete and in good condition, no later than 14 days after this notification; return costs are at their expense.

The seller refunds all sums paid, including the initial delivery costs at the standard rate, no later than 14 days after being informed of the withdrawal. The refund may be withheld until the product has been received or proof of its dispatch provided.

The right of withdrawal does not apply to professional customers, to material made to the customer’s specifications (for example a binding made at their request), or to the hire of material for an agreed date.

2.10 Warranties

Consumer customers: products benefit from the two-year statutory guarantee of conformity from delivery, under the Belgian Civil Code. In the event of non-conformity, the consumer is entitled to repair or replacement of the product and, if neither is possible, to a price reduction or refund.

Professional customers: any claim concerning an apparent defect or non-conformity must be notified in writing within eight days of receipt. The warranty is limited to the replacement of products acknowledged as defective.

2.11 Liability

The seller is bound by a best-efforts obligation. It cannot be held liable for damage resulting from force majeure or from the use of the Internet, within the limits permitted by law.

The products comply with Belgian law. The seller cannot be held liable if their importation or use is restricted by the law of the country of delivery (see article 2.2).

2.12 Personal data

Data provided when placing an order is used solely to process and invoice it. See our privacy policy.

2.13 Governing law & disputes

These terms are governed by Belgian law, without prejudice to any more protective mandatory provisions of the law of the consumer customer’s country of residence.

In the event of a problem, the customer is invited first to contact the seller at sales@21-music.be to seek an amicable solution. Consumer customers may also apply free of charge to the Belgian Consumer Mediation Service (Service de médiation pour le consommateur), North Gate II, boulevard du Roi Albert II 8, boîte 1, 1000 Brussels — www.mediationconsommateur.be ↗.

Failing agreement, and subject to the jurisdiction rules protecting consumers, the courts of the judicial district of Halle-Vilvoorde have exclusive jurisdiction.

2.14 Severability

The invalidity or illegality of any clause of these terms does not affect the validity of the other clauses, which remain fully applicable.

Orders: data provided when placing an order or requesting a quotation (name, postal address, email address, country) is used solely to process, deliver and invoice it, and kept for the period required by accounting obligations. It is never transferred or used for advertising.

Hosting: the site is hosted by Vercel, which processes the technical data strictly necessary for its operation and security (server logs), in accordance with its privacy policy ↗. XXI Music Publishing does not use this data for tracking.
